By accessing, browsing, or using the Lava NFT platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Lava NFT provides a platform for the creation, purchase, sale, and trading of non-fungible tokens (NFTs) on the Solana blockchain. Our services include:

• NFT marketplace functionality
• Staking mechanisms for NFT holders
• $LAVA token distribution and governance
• Community features and DAO participation
• Metaverse integration and utilities

You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction to use our Service. By using our Service, you represent and warrant that:

• You are of legal age in your jurisdiction
• You have the authority to enter into these Terms
• Your use of the Service is not prohibited by applicable law
• You are not located in a jurisdiction where our Service is restricted

When you purchase a Lava NFT, you own the underlying NFT completely. This ownership includes:

• The right to sell, trade, or transfer your NFT
• Access to holder-exclusive benefits and utilities
• Participation in governance and community decisions
• Commercial use rights for personal projects (up to $100,000 in revenue)

However, ownership does not include the underlying intellectual property rights to the artwork, which remain with Lava NFT unless explicitly transferred.

$LAVA tokens are utility tokens designed to facilitate ecosystem participation. Important considerations:

• $LAVA tokens are not securities or investment contracts
• Token value may fluctuate and could become worthless
• Tokens are earned through staking and ecosystem participation
• We make no guarantees about token utility or future value
• Regulatory changes may affect token functionality

You agree not to use our Service for any unlawful purpose or in any way that could damage our platform or community:

• Money laundering or other financial crimes
• Market manipulation or wash trading
• Creating fake accounts or impersonating others
• Attempting to hack or exploit our systems
• Harassment or abuse of community members
• Violation of intellectual property rights

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Security of transactions or data
• Accuracy of information provided

Blockchain transactions are irreversible. We cannot recover lost NFTs, tokens, or funds due to user error, smart contract bugs, or blockchain issues.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAVA NFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING:

• Loss of profits, data, or business opportunities
• Damages resulting from NFT or token value fluctuations
• Technical failures or blockchain network issues
• Unauthorized access to your wallet or accounts
• Third-party actions or platform integrations

Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration.
